The Italian legislation (in particular, Article 122 of the Privacy Code – Legislative Decree 196/2003 as amended by Legislative Decree No. 101 of August 10, 2018) has incorporated into our legal system the EU regulation which requires website operators who use cookies or other tracking technologies to inform the user about the types of any cookies used by the site and to obtain their prior consent for the sending of such cookies to the user’s terminal and/or for access to the information stored therein.
The only exceptions to the consent requirement are those cookies that are technical and/or analytical with a low identification profile, which are necessary for the management of the site or for the provision of services expressly requested by the user. This is also taken into account in the EU Regulation 2016/679 of April 27, 2016, which in its Recital 26 states that “It is desirable to apply data protection principles to all information relating to an identified or identifiable natural person” and that “Personal data subjected to pseudonymization, which could be attributed to a natural person by the use of additional information, should be regarded as information on an identifiable natural person” (thus excluding so-called analytical cookies).
The Data Protection Authority has also intervened with the provision entitled “Identification of simplified methods for the information and obtaining of consent for the use of cookies” dated May 8, 2014 (published in the Official Gazette No. 126 on June 3, 2014), which is integrated with the Guidelines on cookies and other tracking tools adopted on websites on June 10, 2021 (published in the Official Gazette No. 163 on July 9, 2021).
Furthermore, EU Regulation 2016/679 of April 27, 2016, in its Recital 30, also provided that “Natural persons may be associated with online identifiers produced by the devices, applications, tools, and protocols used, such as IP addresses, with temporary markers (cookies) or with other identifiers, such as radio frequency identification tags. These identifiers may leave traces that, particularly if combined with unique identifiers and other information received from servers, can be used to create profiles of natural persons and to identify them.”
